THIS IS NOT RIGHT!!!! HELP WHAT SHOULD I DO
Question: i got a load coming out of a huge company in texas, the transportation company that handles all the loads going out of that location, you've heard of them.. lets call them "x.e. france".. can you figure it out? anyways, they handle all the loads, i call them up to get a load they nicley reject me... then i get a call from the same broker who gave me the load last time, i have no choice but to take it... but i am kinda iffy about it, cuz i still havent seen my check and its been over 20 days, he sait it would only take 9. i figure this brokerage gets loads out of there and so does xe france... well he tells me this load pays 2000 he takes his 10% and im getting 1800. ok i guess thats the way it is.. i have no choice its friday and i goota get the driver out of there 2 or 3 hours later i get a call from guess who, the rep from XE FRANCE, the same one who turned me down, i missed the call and got a msg, she says "this is so and so from xe france i wanna know if the car got loaded up alllright in texas, call me back" so let me get this straight cr... i mean xe france gets the loads from this huge company and get fooled by all these little brokerages tell them that they have cars... then they pass the load to another company and take 10% off the top... so you got cr... i mean xe france making profit off the load..... then you got a brokerage, takeing that load and taking 10% off the top and passing it down to me... so i got 2 brokers making money off one load.... then i get it... does nto seem right..... one problem that really really bothers me!!!!!!!!!!!!!!!! is the fact that CR.. i mean xe france called me heard my answering mashince stating it was a diffirent caring comapny.... then the one she gave it to... and didint have a probelm with it... she didint have a probelm with the double brokerage that was going on... i just want to get my 3 checks from this brokerage, and stop dealing with them... i hope they pay.... it just really bothers me that cr engalnd has good loads that should be avalible to all caring comapnys... but that brokerage only gives them out to this guy... and this guy takes 10% off the top... i look real hard for loads on posting sites, i call shippers i call storages... i call the big comapny they tell me to call CR.. i mean XE france, (they handle all the loads) they give me the phone # and and name of the person to talk to... i call and give them all my info and everything else.. , they would still rather double broker the load.. isisnt that against the law??? i guess i am just venting. but if cr england were to have sent my check insted of my check going to the broker.... then to me.. i would alklready have it insted of wating for 5k, from the broker... if i dont get that check soon, i am going to have probelms with fuel next week. should i just sit tight and not say anything. it does not seem fair. Answer: "Double Brokering" goes on all the time on a daily basis in this industry. Is it illegal? Supposedly not, however, enforcement is non-existent so they keep doing it as SOP knowing, by and large, they can get away with it. Whichever parties hold the load confirmation/agreement, that is who they are responsible for paying. The broker took the load from "xe france," xe france pays the broker. You book the load through the broker, the broker pays you. If the confirmation/agreement states 30 day pay (it can be found in the e fine print usually) then you can expect it in a 30-45 day range. If that is not happening, time to put that carrier/broker on your no load list. You also have the option of filing on that carrier/brokers bond, which you confirmed was current and on file prior to booking the load? It always pays to check out such things as credit standing and bond issuance prior to doing business with carriers/brokers in today’s market. Fly by night outfits are not unheard of and even the well known and established outfits can run into hard times, especially given the current price of fuel. Answer: whta about the SCAC, or the OOIDA, dont they take responsibilty in making sure these kinds of things dont happen... for all we know the broker at xe france makes a certin amount no matter what, they give it to the broker that i got the load from... they make 200 bucks, then splits it with the broker from xe france( on the side) she would be doing that so she can rip off the company she works for... that could be happening, she tell the broker that i got the load from ok you dont want to pay me... then i wont give u the loads anymore. then the broker says ok i will pay you for every load you give me... now us poor carers are a victim of these dishonest brokers. Answer: For one CR. England and CH Robmesomemore are in HIGH competition in TX right now. To answer your question Answer: Double or even triple brokering is NOT against the law, although it should be. It is unethical however, but when you get some small lazy broker out there who doesn't want to the legwork to obtain customers the right way, this is what you end up with. Answer: Keep looking, sooner or later you will find the right company to give freight to you instead of the big guys. Just keep one thing in mind. The reason why they (the big companies) give freight to companies like CH Robmesomemore and CR. England and Intransit is because they can provide more than just one car to cover their needs. In this case, more is better. Answer: Answer: SCAC won't even answer trhe phone for you since they have nothing to do with it. OOIDA won't do anything for just one guy, unless you own a few more cars and pay more than just one membership fee. Answer: Let me help you with this. 1. CR England does not pay CH Robinson to move CH's freight. CH will pay CR to move it for them, thats double brokering. However unethical it is, it happens more and more each day and screws more carriers than I Can name. There are more than just 2 companies that CH will do this with. One company I USED to work for had a broker in there and thats all he did was move freight he got from CH Robinson. Even though I didn't like it, the boss made money on it, although it was a small amount, but he was allowed to continue doing this because of the simple fact that he made money. The best advice I can offer is to keep track of which brokers do this and do not load for them. There are honest brokers out there who will answer the phone at 3 a.m. and help you with any problems you may have while under their load. I know, I used to be one of them. Answer: but since i got in with cr england allready talk to the divison who gives out those loads.... asked them for a load they turned me down.... the same time, the car broker is calling me telling me they have something.. (he got it from cr england) it either tells me one or two things/ the broker at cr england is making money twice... selling it to the other broker... then that broker selling it to me.... she gets creddit for her agent job at cr england... and splits the profits with the other broker... or she does not know, but that is not the case since she called me and heard my answering machine to check on the car.... why would she put this other broker in the middle... what good is he to her, she puts him in the middle and STILL makes check calls, even tho it should be broker #2's responsibilty, she either is letting this broker get one over on her and she does not realize it... and is the type of girl who did everyones homework in high school or she is taking a split in the second brokers profit. ripping off her company. if you worked for cr england, and you had these loads, u sold them to a broker.. then u still make his check calls? u have all the caring companys and drivers #s?? and do his job... ?? which was your job to begin with..., but for some reason u put this guy in texas in the middle, for what? nothing more then a pawn, for her to get more $$$, Answer: enough of my conspicary theorys, i know i am probably way off.. Answer: Answer: Some of the bigger brokerages will "sell" their loads to a smaller broker. The only thing is this. The original broker (if they did their homework) will see the other broker as a CARRIER, meaning the original broker thinks the goods are being hauled by the other brokers own car. People in this industry are strange and will do anything to make $25.00. In the end everyone makes a little money.
